General Terms and Conditions for Hint-Caching

The contract for the purchase of hint caching tickets is concluded with the operating company or a third party commissioned by the respective operating company to sell tickets.

1. Scope of the General Terms and Conditions

These General Terms and Conditions govern all business relationships between Hint-Caching and its customers. By booking a time slot or purchasing access data for products to be delivered digitally on www.hint-caching.com, the customer agrees to the General Terms and Conditions.

2. Liability

2.1 Operator's liability: Hint-Caching is not liable for lost valuables, clothing or damage to health or physical injury. Hint-Caching also assumes no duty of care.
2.2 Claims by the customer for damages are excluded.
2.3 In the event of a breach of material contractual obligations, Hint-Caching shall only be liable for the foreseeable damage typical of the contract if this was caused by simple negligence.
2.4 The limitations of clauses 2.2 and 2.3 also apply in favor of Hint-Caching's legal representatives and vicarious agents if claims are asserted directly against them.
2.5 The provisions of the Product Liability Act remain unaffected.

3. Conditions of participation and minimum age

3.1 Participation in hint caching is at your own risk.
3.2 There is no minimum age for smartphone games. However, we recommend a minimum age of approx. 14 years and, if necessary, adult supervision.
3.3 People who suffer from health-threatening illnesses are not advised to take part in the game. Hint-Caching accepts no liability for any resulting accidents, damage or harm to health.
3.4 Photography, video recording and duplication are not permitted.
3.5 Smoking is not permitted during the game.
3.6 Playing under the influence of alcohol or drugs is not permitted.
3.7 The rules of the game will be communicated to the participants in a briefing before the game.

4. Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the date of conclusion of the contract.
To exercise the right of withdrawal, you must inform us (Schädel und Brendler GbR, Inge-Meysel-Straße 16E, 85053 Ingolstadt, info@hint-caching.de) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You can also fill in and send a corresponding unambiguous declaration electronically on our website www.hint-caching.com. If you make use of this option, we will immediately send you a confirmation of receipt of such a revocation (e.g. by e-mail). In order to comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this repayment.

5. Withdrawal of the customer

Special note on the corona pandemic and similar circumstances: The fluctuating security situation (risk of infection) due to pandemics and similar circumstances is well known. Booking is at your own risk. If Hint-Caching is allowed to carry out its games by the authorities, booked games cannot be canceled at the customer's request.

6. Cancellation by the customer

If the customer has made an incorrect booking (e.g. by purchasing too many or the wrong tickets or similar) and wishes to cancel the booking, Hint-Caching reserves the right to withhold the resulting cancellation costs incurred by the payment provider and Hint-Caching from the refund amount. Cancellation costs are a flat rate of 5,- Euros gross per ticket.

7. Validity of tickets and dates

Tickets for a smartphone city game are valid for 1 year from the date of purchase and can be started, paused and continued at any time. No agreement with the operator is necessary for this.

8. Choice of law, place of performance, place of jurisdiction, severability clause

8.1 Business relations of any kind between Hint-Caching and the customer shall be governed by German law to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
8.2 The place of performance for all claims arising between Hint-Caching and the Client from the business relationship is the registered office of the company as stated under 1.2.
8.3 If individual provisions of these GTC are or become invalid, this shall not affect the validity of the remaining provisions. The invalid provisions shall be replaced by the provision that is customary in the industry for this case; in the absence of a permissible provision customary in the industry, the statutory provision shall apply.
